Terms of Service
These Terms govern your use of jmallgh.com — a multivendor ecommerce mall in Ghana that includes negotiation systems, slightly used listings, and integrated delivery services.
1. Acceptance of Terms
By accessing or using jmallgh.com which belongs to Jmall Online Shopping Center, you agree to these Terms. If you do not agree, you must stop using the platform immediately. Continued use means full acceptance of these Terms and related policies including Privacy, Refund, Seller, Delivery, Negotiation, and Slightly Used policies.
2. Platform Overview
Jmallgh.com is a community-based multivendor ecommerce mall operating in Ghana. The platform connects buyers, vendors, slightly used sellers, and logistics providers. Jmallgh.com may also act as a retail facilitator and mall operator to enable transactions, delivery, negotiation, and product discovery services.
3. Eligibility
Users must be at least 18 years old or use the platform under the supervision of a legal guardian. By using the platform, you confirm that you meet these requirements and are legally capable of entering binding agreements.
4. Supplier Model
All registered vendors act as suppliers who provide product listings and inventory information to Jmallgh.com. Vendors are responsible for product accuracy, availability, pricing integrity, and lawful sale of goods. Jmallgh.com facilitates sales, visibility, negotiation systems, payments processing, and logistics coordination.
5. Orders & Payments
Jmallgh.com applies a commission fee (currently 5%) on successful transactions unless otherwise stated. Payments are processed via third-party providers such as Hubtel and Mobile Money systems. Vendor payouts may be released after delivery confirmation, successful order completion, or verified dispute resolution.
6. Negotiation System
Jmallgh.com provides a negotiation feature that allows buyers to request price adjustments through an automated or semi-automated bargaining system. Final pricing depends on vendor rules, stock availability, promotions, demand, and system logic. All negotiated orders are binding once accepted by both parties. Abuse of the negotiation system—including fake bargaining, refusal to complete agreed purchases, manipulation attempts, or repeated disruptive behavior—may result in account restrictions, suspension, or permanent termination.
7. Slightly Used Products
A limited portion of products listed on Jmallgh.com may be slighty used, refurbished, or slightly used. These products are clearly provided and controlled by participating vendors. Vendors are responsible for accurately describing product condition. Slightly Used items are subject to stricter return eligibility and may only qualify for refund or return if they are wrongly delivered, significantly not as described, or arrive damaged.
8. Delivery & Responsibility
Delivery services may be provided by Jmall logistics riders, third-party couriers, or vendors depending on order type and location. Responsibility for delivery issues such as delays, loss, or damage is determined through case-by-case investigation involving the buyer, vendor, and logistics partner. Risk transfers to the customer upon successful delivery or pickup confirmation.
9. Returns & Refunds
Customers may request returns or refunds within 7 days of delivery or pickup depending on product type. All requests are subject to inspection, validation, and approval under the Refund & Return Policy.
10. Pricing Errors
Jmallgh.com reserves the right to cancel, adjust, or refund orders affected by system errors, pricing bugs, or obvious listing mistakes, even after order placement.
11. User Conduct
Users must not engage in fraud, fake orders, abuse of negotiation systems, spam activity, manipulation of pricing systems, or any activity that disrupts platform integrity. Violations may result in suspension or permanent account termination.
12. Content Rights
Users retain ownership of uploaded content but grant Jmall Online Shopping Center a worldwide, royalty-free, transferable, sublicensable license to use, display, modify, distribute, and promote such content for platform operation, marketing, and service improvement purposes.
13. Intellectual Property
All platform branding, design, UI/UX, software, systems, and trademarks are owned by Jmall Online Shopping Center. Unauthorized copying, reproduction, or misuse is strictly prohibited.
14. Data & Privacy
User data is collected and processed in accordance with our Privacy Policy. This may include personal data, transaction data, negotiation activity, and usage analytics necessary for platform operations and improvements.
15. Government Requests
Jmall Online Shopping Center may disclose user data to government or law enforcement authorities when required by valid legal requests, court orders, or regulatory obligations.
16. Limitation of Liability
Jmall Online Shopping Center is not liable for indirect damages, loss of income, delays, supplier misconduct, logistics failures, system downtime, or external events beyond reasonable control. Liability is limited to the value of the affected transaction where legally applicable.
17. Termination
Jmall Online Shopping Center reserves the right to suspend, restrict, or terminate accounts that violate these Terms, engage in fraudulent activity, abuse negotiation systems, or misuse the platform in any form.
18. Pay Small Small (Instalments)
Pay Small Small is an optional instalment programme that lets you buy approved products and pay over a period you select (typically 1–8 weeks). On a Pay Small Small order, Jmall Online Shopping Center acts as the principal seller: Jmall acquires the product, holds it in its warehouse, and ownership and delivery of the product pass to you only after you have completed all scheduled payments. Choosing Pay Small Small adds a credit price markup to the standard cash price. This markup is a percentage set by Jmall that may change from time to time; the exact percentage and amount that apply to your purchase are displayed to you before you pay. The markup forms part of the agreed sale price and is not interest. You commit by making an initial down payment, then pay the remaining balance in instalments before the end of your selected period. If you do not complete payment within your selected period, the plan may be cancelled and the product returned to available stock. In that case a default charge is retained from the amounts you have already paid, and the remaining balance of what you have paid is refunded to you through a supported payment method. The default charge is a percentage set by Jmall that may change from time to time, and the applicable percentage is displayed to you before you pay. Specific prices, down payments, schedules, and charges are shown to you before you confirm and are further governed by the Refund & Return Policy.
19. Updates
Jmall Online Shopping Center may update these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.
